These Privacy Policy and Terms & Conditions apply when you visit our website, submit a form, subscribe to updates, purchase or attend any class, workshop, private lesson, photo walk, creative shoot session, online training, or related educational event, collectively referred to as “Events.”

1. Information We Collect

We may collect information you provide directly, information collected automatically through the website, and limited information from trusted third-party service providers.

Registration / Booking Details Name, email address, phone number, billing information, selected class, and attendee details. When you submit a form, subscribe, register, or purchase a class or workshop.
Payment Information Payment confirmation, transaction ID, last four digits, and payment tokens handled by payment processors. During checkout or payment processing.
Communications Emails, text messages, form responses, support requests, survey responses, or class questions. When you contact us or respond to communications.
Optional Media / Uploads Photographs, files, or materials you voluntarily submit for critique, review, gallery use, or educational purposes. Only when you choose to submit them.

We may receive payment status confirmations, analytics, advertising performance information, and campaign metrics from services such as Stripe, WooPayments, PayPal, Google Analytics, Meta, Mailchimp, Twilio, or similar tools used to operate, market, and improve our classes and website.

Terms & Conditions

These Terms & Conditions form a binding agreement between you, the participant or purchaser, and 360ism Studios LLC. They apply to all purchases, registrations, attendance, participation, and use of the website and related class services.

1. Acceptance of Terms

By clicking “Book,” “Pay,” “Submit,” “Register,” or otherwise enrolling in a class, workshop, private lesson, or related Event, you confirm that you have read, understood, and agree to these Terms.

2. Accurate Information

You agree to provide accurate contact, billing, and registration information. We are not responsible for missed confirmations, reminders, updates, or class changes caused by incorrect or outdated information.

3. Class Listings, WPForms, and Checkout

Classes may be listed through WPForms, WooCommerce, email links, payment links, or other registration systems. The class description, date, time, location, price, and checkout instructions shown at the time of registration control your booking, unless we notify you of a correction or change.

Booking, Payment & Attendance

1. Booking Confirmation

A booking is confirmed once payment, approved deposit, or approved registration has been received and processed. You may receive confirmation by email, SMS, receipt, or automated checkout notice.

2. Accepted Payment Methods

We may accept credit cards, debit cards, PayPal, WooPayments, Stripe-powered payments, approved buy-now-pay-later options, electronic funds transfer, or other payment methods made available at checkout.

3. Pricing and Taxes

Unless otherwise stated, prices are listed in U.S. dollars. Applicable taxes, fees, or processing charges may be added or included depending on the checkout method and class structure.

4. Deposits and Payment Plans

If deposits, partial payments, payment plans, or reserve-your-seat options are offered, the remaining balance must be paid by the stated deadline. Failure to complete payment may result in cancellation of the seat without refund of any non-refundable deposit, unless otherwise required by law.

5. Check-In and Late Arrival

For in-person Events, participants should arrive at least 10 minutes before the advertised start time. Late arrivals may miss important instruction and may be refused entry or asked to wait until an appropriate break, without refund.

Cancellations, Refunds & Rescheduling

Participant-Initiated Cancellations

  • Refund requests must be made within 48 hours after the initial ticket purchase, unless a different refund window is stated on the specific class listing.
  • Free rescheduling may be allowed up to 48 hours before the Event, subject to availability.
  • Each booking may be rescheduled a maximum of three times unless we approve otherwise in writing.
  • No refunds or credits are guaranteed for cancellations made less than 48 hours before the Event or for no-shows.

360ism-Initiated Cancellations or Changes

We may cancel, postpone, relocate, or reschedule an Event due to severe weather, instructor illness, insufficient enrollment, venue issues, equipment issues, safety concerns, emergencies, or force majeure events.

If 360ism cancels an Event, participants will be offered a transfer to a new date or a refund of the Event fee paid. Our liability is limited to the amount paid for the Event.

Recommended checkout note: If a specific class has a different refund or rescheduling rule, place that rule clearly on the class registration form or checkout page.

Participant Conduct, Safety & Equipment

1. Code of Conduct

Participants must behave professionally, respectfully, and safely toward instructors, models, staff, other participants, and property. Harassment, discrimination, disorderly conduct, unsafe behavior, or disruption may result in removal without refund.

2. Safety Instructions

Participants agree to follow instructions related to lighting equipment, stands, cables, backdrops, props, studio areas, model interaction, and venue rules.

3. Age Requirements

Participants under 18 must have parent or guardian approval and may be required to attend with a supervising adult. Some workshops may have additional age restrictions based on content, subject matter, or model releases.

4. Health and Mobility

You are responsible for determining whether you are physically able to participate. Contact us before booking if you need reasonable accommodations or have health, mobility, or accessibility concerns.

5. Personal Property

You are responsible for your own camera gear, lenses, accessories, computers, bags, and personal property. 360ism is not responsible for lost, stolen, or damaged personal property except where required by law.

6. 360ism Equipment and Property

If you use 360ism equipment, sets, props, lighting, or studio property, you agree to use it safely and return it in the same condition. You may be responsible for damage, loss, or misuse beyond normal wear.

Media, Model Releases & Intellectual Property

1. Instructional Materials

Slides, handouts, videos, diagrams, class materials, written guides, forms, and other educational content provided by 360ism are protected intellectual property and may not be copied, sold, distributed, republished, or used for competing instruction without written permission.

2. Participant Images

You generally retain copyright to photographs you personally create during a class or workshop, subject to any model releases, location rules, class restrictions, and usage limitations disclosed for that Event.

3. Model Releases

When models, muses, or talent are provided, usage rights may be limited by a model release or class-specific agreement. Some images may be limited to portfolio, educational, social media, or non-commercial use only unless additional permissions are obtained.

4. Promotional Use by 360ism

360ism may request permission to use participant images, behind-the-scenes media, testimonials, class photos, or student work for promotional purposes. Where permission is required, we will seek appropriate consent.

5. Unauthorized Commercial Use

Participants may not use images from classes or workshops in a commercial, adult, defamatory, misleading, or unauthorized manner if that use violates the model release, class rules, venue rules, or applicable law.

Liability, Force Majeure & Disputes

1. Liability Waiver

You participate at your own risk. To the fullest extent permitted by Virginia law, you release 360ism Studios LLC, its owners, instructors, employees, contractors, assistants, and agents from claims for personal injury, property damage, loss, or other harm arising from attendance or participation, except where caused by gross negligence or willful misconduct.

2. Limitation of Liability

To the fullest extent permitted by law, 360ism’s total liability for any Event-related claim is limited to the amount paid by you for the specific Event giving rise to the claim.

3. Force Majeure

360ism is not liable for delay, cancellation, relocation, or failure to perform caused by events beyond reasonable control, including natural disasters, severe weather, illness, government restrictions, pandemics, labor disputes, power outages, venue issues, internet outages, or emergencies.

4. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

5. Dispute Resolution

Any dispute arising under these Terms or related to an Event will be resolved exclusively in the state or federal courts located in Richmond, Virginia, unless otherwise required by law.
